Special equipment service administration regulation
1 General provisions
1.1 Objectives
The Regulation is formulated based on Special Equipment Safety Law of the People's Republic of China, Work Safety Law of the People's Republic of China, Energy Conservation Law of the People's Republic of China and Regulations on Safety Supervision of Special Equipment to regulate the special equipment service administration and ensure the safe and economic operation of special equipment.
1.2 Application scope
The Regulation is applicable to the safety and energy conservation administration of special equipment within the scope of Special Equipment Catalogue.
1.3 Primary responsibility of user
Special equipment user shall, in accordance with the provisions of the Regulation, be responsible for the safety of special equipment and energy conservation administration and undertake the primary responsibility for the service safety and energy conservation of special equipment.
1.4 Supervision and administration
1.4.1 Division of responsibilities
Departments of local people's governments at all levels above the county responsible for the safety supervision and administration (hereinafter referred to as special equipment safety supervision and administration departments) shall be responsible for the supervision and administration of the service safety of special equipment and energy conservation of high energy-consuming special equipment. The AQSIQ supervises and guides the supervision and administration of the service safety of the special equipment and the energy conservation of high energy-consuming special equipment throughout the country.
1.4.2 Service registration
Special equipment safety supervision and administration departments are, in accordance with lawful duties and the requirements of the Regulation, responsible for handling the service registration of special equipment, except for the special equipment for which service registration is clearly not required in the Regulation and other special equipment safety technical specifications (hereinafter referred to as safety technical specifications).
1.4.3 Supervision & inspection
For the special equipment having been subjected to service registration, the special equipment safety supervision and administration departments, based on the risk status and in accordance with the principles of classified supervision, determine the focus of supervision and inspection, make supervision and inspection plan, and carry out on-site supervision and inspection for the service safety of the special equipment and the energy conservation implementation of high energy-consuming special equipment within the corresponding administration area.
1.4.4 Informatization and safety status announcement
The special equipment safety supervision and administration departments responsible for handling the service registration shall, according to the requirements of informatization administration of special equipment, establish special equipment administration information system, and timely input and update the relevant data.
The AQSIQ and the provincial special equipment safety supervision and administration departments shall announce the general safety status of special equipment to the public every year, and the special equipment safety supervision and administration departments below the provincial level shall timely announce the safety status of special equipment within their respective administrative areas according to the needs of their work.
2 Users and their personnel
2.1 Users
2.1.1 General requirements
The users in the Regulation refers to the unit with the right of service administration over special equipment (note 2-1) or a natural person with full capacity for civil conduct, which is generally the property unit of special equipment (the owner of property right, the same below), or the actual service administrator of special equipment established by the property unit through the contractual relationship in accordance with the provisions of the law. If the special equipment is in common, the co-owner may entrust the property service unit or other administrator to administrate the special equipment, and the trustee is the user; if the co-owner does not carry out such entrustment, the actual administrator is the user; if there is no actual administrator, the co-owner is the user.
If the special equipment is used for rental, the rental unit is the user during the rental period; if otherwise provided by law or agreed in the contract between the parties, the provisions or agreement shall apply.
Note 2-1: Units include companies, subsidiaries, government offices and public institutions, social organizations and other units with legal personality as well as such branches and individual industrial and commercial households as with business license.
2.1.2 Special provisions
For newly installed elevators that have not been handed over to the owner, the project construction unit is the user; for elevators entrusted to property service unit for administration, the property service unit is the user; for elevators administrated by the property unit itself, the property unit is the user.
The user of gas cylinders generally refers to the filling unit, while the user of gas cylinders for vehicle, non-refillable gas cylinders and gas cylinders for respirator refers to the property unit.
2.2 Main obligations of users
Main obligations of users of special equipment are as follows:
(1) establishing and effectively implementing the special equipment safety administration system, high energy-consuming special equipment energy conservation administration system and the operation procedures;
(2) purchasing and producing the special equipment with the obtained license (including design, manufacture, installation, reformation and repair, the same below) and qualified upon inspection; it is forbidden to purchase special equipment beyond the design life, and it is forbidden to use special equipment that has been explicitly eliminated and scrapped by the state;
(3) setting up special equipment safety administration organization, equipping with corresponding safety administration personnel and operating personnel, establishing personnel administration ledger, and carrying out safety and energy conservation training and education, with the personnel training records kept;
(4) going through the service registration, and getting the “Special equipment service registration certificate” (see Annex A for the format, hereinafter referred to as the service registration certificate), which shall be returned when the equipment is cancelled;
(5) establishing special equipment ledger and technical archives;
(6) inspecting the operation conditions of the special equipment operating personnel and timely correcting the illegal operation;
(7) carrying out regular maintenance and self-inspection on the in-service special equipment to timely check and eliminate the hidden dangers of accidents, regularly checking (verification and calibration, the same below) and repairing the safety accessories, safety protection devices and their auxiliary instruments and meters of the in-service special equipment, timely applying for regular inspection and energy efficiency test, accepting regular inspection and energy efficiency test, and properly carrying out relevant coordination works;
(8) formulating special equipment accident-specific emergency response plan, and conducting emergency drills regularly; reporting accidents in time and cooperating in accident investigation and handling;
(9) ensuring the necessary investment for the safety and energy conservation of special equipment;
(10) others obligations as prescribed by the laws and regulations.
The users shall accept the supervision and inspection carried out in accordance with laws by the special equipment safety supervision and administration departments.
2.3 Special equipment safety administration organization
2.3.1 Responsibility
The special equipment safety administration organization refers to the internal organization of users that undertakes the responsibility of special equipment safety administration. The user of high energy-consuming special equipment may hand over the responsibility of energy conservation administration to the special equipment safety administration organization.
The responsibility of the special equipment safety administration organization is to implement the relevant national laws, regulations, safety technical specifications and relevant standards of special equipment, and implement the main obligations of the users; the organization undertaking the responsibility of high energy-consuming special equipment energy conservation administration shall also be responsible for carrying out daily energy conservation inspection and implement the energy conservation responsibility system.
2.3.2 Organization structuring
The special equipment users meeting one of the following conditions shall set up special equipment safety administration organizations according to the types, varieties, uses and quantities of their special equipment, and determine safety responsible persons for each equipment:
(1) using power station boilers or complete petrochemical and chemical plants;
(2) using elevators that provide operational services for the public (note 2-2), or using more than 30 (inclusive) elevators in public gathering places (note 2-3);
(3) using more than 10 (inclusive) large-scale amusement devices, or using more than 10 (inclusive) non-highway tourist vehicles providing operational services for the public;
(4) using passenger aerial ropeways or passenger cable cars;
(5) using all kinds of special equipment (excluding gas cylinders) with the total amount of more than 50 (inclusive).
Note 2-2: A user of special equipment that provides operational services for the public refers to a user who uses the special equipment as a operation tool.
Note 2-3: Public gathering places refer to schools, kindergartens, medical institutions, stations, airports, passenger terminals, shopping malls, dining places, stadiums, exhibition halls, parks, hotels, theaters, libraries, children's activity centers, public baths, old-age care institutions, etc.
2.4 Administration personnel and operating personnel
2.4.1 Main person-in-charge
The main person-in-charge refers to the actual top manager of the special equipment user, who is responsible for the safety and energy conservation of the special equipment used by the user.
2.4.2 Safety administration personnel
2.4.2.1 Person in charge of safety administration
The special equipment user shall allocate a person in charge of safety administration. The person in charge of special equipment safety administration refers to the person in charge of the service safety administration of special equipment in the top management of the user. The person in charge of safety administration of users setting safety administration organization according to those specified in the Regulation shall obtain the corresponding qualification certificate for safety administration personnel of special equipment.
Responsibilities of the person in charge of safety administration are as follows:
(1) assisting the main person-in-charge to perform the leadership responsibility for the safety of special equipment of the unit and ensuring the safe service of special equipment of the unit;
(2) promoting and implementing the Special Equipment Safety Law of the People's Republic of China and relevant laws, regulations, rules and safety technical specifications;
(3) organizing to formulate the special equipment safety administration system of the unit, and implementing the setup of special equipment safety administration organization and the allocation of safety officer;
(4) organizing to formulate special equipment accident-specific emergency response plan and organizing periodic drills;
(5) checking the implementation of safety administration of special equipment in the unit;
(6) organizing the investigation of potential safety hazards and putting forward treatment opinions;
(7) when the safety officer reports that the special equipment has safety hazards and shall fall out of use immediately, immediately making a decision to stop using the special equipment and reporting it to the main person-in-charge of the unit in time.
2.4.2.2 Safety officer
2.4.2.2.1 Responsibilities of safety officer
The special equipment safety officer refers to the personnel in specific charge of the service safety administration of the special equipment.
The main responsibilities of the safety officer are as follows:
(1) organizing to establish safety technical archives of special equipment;
(2) going through the special equipment service registration;
(3) organizing to formulate special equipment operation procedures;
(4) organizing special equipment safety education and energy conservation training;
(5) organizing periodic self-inspection of special equipment;
(6) preparing regular inspection plan for special equipment, and supervising the implementation of periodic inspection and safety hazards governance;
(7) reporting special equipment accidents according to regulations, participating in special equipment accident rescue, and assisting in accident investigation and aftercare;
(8) dealing with the potential accident hazards of special equipment immediately once they are found; if the situation is urgent, making a decision to stop using the special equipment and reporting it to the person in charge of safety administration of the unit in time;
(9) correcting and stopping the illegal behavior of special equipment operating personnel.
2.4.2.2.2 Allocation of safety officer
The user of special equipment shall allocate an appropriate number of safety officers according to the quantity and characteristics of special equipment of the unit. The users setting safety administration organization according to those specified in the Regulation and the special equipment users meeting one of the following conditions shall allocate a full-time safety officer who shall obtain the corresponding qualification certificate for safety administration personnel of special equipment:
(1) using boilers with rated working pressure greater than or equal to 2.5 MPa;
(2) using more than 5 (inclusive) Category III stationary pressure vessels;
(3) engaging in filling transportable pressure vessel or gas cylinder
(4) using industrial pipeline of more than 10 kilometers (inclusive);
(5) using transportable pressure vessels, or passenger towing ropeways, or large-scale amusement devices;
(6) using all kinds of special equipment (excluding gas cylinders) with the total amount of more than 20 (inclusive).
Users other than those specified above may allocate part-time safety officers, or entrust a person with the qualification of special equipment safety administration personnel to be responsible for the service administration, but the responsible subject for the special equipment safety service is still the user.
2.4.3 Energy conservation administration personnel
The users of high energy-consuming special equipment shall allocate energy conservation administration personnel to be responsible for publicizing and implementing laws and regulations on energy conservation of special equipment.
The energy conservation administration personnel of boiler users shall organize the formulation of the boiler energy conservation system of the unit, inspect the implementation of the boiler energy conservation administration, establish boiler energy conservation technical archives, organize boiler energy conservation education and training, prepare the boiler energy efficiency test plan and supervise the implementation of regular boiler energy efficiency test.
2.4.4 Operating personnel
2.4.4.1 Responsibilities of operating personnel
Special equipment operating personnel shall obtain the corresponding special equipment operating personnel certificate and have responsibilities as follows:
(1) strictly implementing the relevant safety administration system of special equipment and operating according to the operation procedures;
(2) filling in the operation, duty shift and other records as required;
(3) participating in safety education and skill training;
(4) carrying out regular maintenance, handling the abnormal situation found in time, and making records;
(5) taking emergency measures immediately if safety hazards or other unsafe factors are found during the operation, and reporting to the safety administration personnel of special equipment and the relevant responsible person of the unit in accordance with the prescribed procedures;
(6) participating in emergency drills and mastering corresponding emergency handling skills.
Boiler operating personnel shall strictly implement the boiler energy conservation administration system and participate in boiler energy conservation education and technical training.
2.4.4.2 Allocation of operating personnel
The user of special equipment shall allocate corresponding certified special equipment operating personnel according to the quantity and characteristics of special equipment in the unit, and shall ensure that at least one certified operating personnel is on duty in each shift when using special equipment. If the relevant safety technical specifications have special provisions for special equipment operating personnel, such provisions shall apply.
Hospital bed elevators, passenger elevators directly used for sightseeing with rated speed greater than 2.5m/s, and elevators that need to be operated by drivers shall be operated by personnel holding special equipment operating personnel certificate.
2.5 Safety and energy conservation technical archives of special equipment
The user shall establish safety and energy conservation technical archives of special equipment for each equipment.
Safety technical archives shall include the following contents:
(1) service registration certificate;
(2) "Special equipment service registration form" (see Annex B for the format, hereinafter referred to as the service registration form);
(3) technical data and documents for design and manufacture of special equipment, including design documents, product quality certificates (including certificates and data sheets, quality certificates), installation and service maintenance instructions, supervision and inspection certificates, type test certificates, etc.
