Article 1 These Regulations are formulated to strengthen quality supervision and safety control of special equipment, ensure product quality and safe service of special equipment, safeguard safety of people's lives and property, and promote economic development and social stability according to the requirements of laws and administrative regulations and responsibilities endowed by the State Council to quality and technical supervision department.
Article 2 Special equipment refers to equipment with higher risk, identified by the State, and that accidents are easy to occur due to influence of the equipment itself and external factors and personal injuries and significant economic loss will occur along with accidents.
As used in these Regulations, the term "special equipment" includes elevators, lifting appliances, motor vehicles in plant, passenger ropeways, amusement rides and amusement devices and explosion-proof electrical equipment etc. Specific catalogues for the special equipment mentioned in these Regulations shall be drawn up by State Bureau of Quality and Technical Supervision according to risk degree and determined after approval of relevant parties before publication and implementation.
Quality supervision and safety control of the explosion-proof electrical equipment shall be separately formulated.
Article 3 These Regulations are applicable to the design, manufacture, installation, service, inspection, repair and maintenance and alteration of special equipment.
Article 4 The State Bureau of Quality and Technical Supervision is responsible for the quality supervision and safety control of special equipment; local administrative departments of quality and technical supervision are responsible for the quality supervision and safety control of special equipment within their respective administrative areas; special equipment safety supervision institutions of administrative departments of quality and technical supervision at or above the country level (hereinafter referred to as special equipment safety supervision institutions) are responsible to implement the quality supervision and safety control of special equipment within their respective responsibility scopes.
Special equipment safety supervision institutions at or above the country level shall emphasize the role of industrial departments and social intermediary organizations when implementing the quality supervision and safety control of special equipment.
Article 5 Technical institutions responsible for the supervision and inspection of special equipment (hereinafter referred to as supervision and inspection institutions) shall be possessed of corresponding conditions and may carry out the supervision and inspection of special equipment of authorized items only after the qualification recognition and authorization of administrative departments of quality and technical supervision at or above the province level.
