Article 1 The Regulations is formulated with a view to guiding/regulating marking of food nutrition labeling, directing consumers to select foods rationally, promoting diet nutrient balance, and protecting the right-to-know and health of consumers.
Article 2 The nutrition labeling marking of the prepackaged food, sold within the territory of People's Republic of China, shall comply with the requirements of this Regulations.
Unless otherwise stated in national laws, administrative rules and standards, they shall apply.
Article 3 The Country encourages food enterprises to mark nutrition labeling for their products.
According to the implementation condition of this Regulations and the consumers health demand, the Ministry of Health will determine the foods and the nutritional ingredients that shall be applied with compulsory nutrition labeling, as well as the implementation time of such compulsory nutrition labeling.
Article 4 The nutrition labeling stated in this Regulations refers to the explanation to indicate consumers with food nutritional ingredient information and characteristic, including nutrition information, nutrition claim and nutritional ingredient function claim.
Article 5 Nutrition information refers to a list of name and content of nutritional ingredients contained in food, which can indicate the information, like energy, nutrient, water and dietary fiber, of nutritional ingredients.
Article 6 Where a food enterprise indicates food nutritional ingredient, nutrition claim, and nutritional ingredient function claim on its labels, the energy, as well as the core nutrients including protein, fat, carbohydrate and natrium, and their contents shall be indicated firstly.
Besides the above ingredients, the food nutrition labeling may also indicate saturated fat (acid), cholesterol, sugar, dietary fiber, vitamin and mineral.
The labeling for the energy and four core nutrients, specified in Item 1, shall be indicated more striking than other nutritional ingredients.
Article 7 The nutritional ingredients on a nutrition labeling shall be expressed by the content in food per 100g(ml) and/or portion, and the percentage of nutritional ingredients contained accounting for the nutrient reference value (NRV) shall be labeled. The definition, determination, labeling method/order, and allowable values tolerance, etc. of nutritional ingredients shall meet the requirements of "Rules for Labeling of Food Nutritional Ingredients".
The specific nutrient reference values (NRV) shall be accordant with "Chinese Nutrient Reference Values".
Article 8 Nutrition claim refers to the description and explanation on food nutritive peculiarities, including:
(I) Content claim: it refers to claims for energy or nutritional ingredient content level in food. The words for the claim include "containing", "high", low" or "no";
(II) Comparison claim: it refers to claims after comparing food (of same kind) nutritional ingredient content or energy value that consumers are familiar with. The words for the claim include "enhanced", "reduced", etc.
Article 9 Nutritional ingredient function claim refers to claims for functions that a nutritional ingredient can maintain normal growth and physiological function of human body.
