Chapter I General Provisions
Article 1 In order to strengthen the supervision and management of the design, manufacturing, installation and nondestructive testing of civil nuclear safety equipment, the Regulations are promulgated in accordance with the "Regulations on the Supervision and Management of Civil Nuclear Safety Equipment".
Article 2 The Regulations shall be applicable to entities engaged in the design, manufacturing, installation and nondestructive testing of civil nuclear safety equipment.
Where maintenance is carried out for any civil nuclear safety equipment outside of civil nuclear facilities, the regulations relating to the manufacturing of civil nuclear safety equipment shall be complied with.
Article 3 The catalogue of civil nuclear safety equipment is compiled and released in batches by Nuclear Safety Regulatory Authority of the State Council.
Article 4 Any entity engaged in the design, manufacturing, installation and nondestructive testing of civil nuclear safety equipment is required to obtain a permit for the design, manufacturing, installation and nondestructive testing of civil nuclear safety equipment and to carry out the activities with regard to the design, manufacturing, installation and nondestructive testing of civil nuclear safety equipment in line with the types, scope and conditions of activity specified in the permit.
Article 5 The operational entity of the civil nuclear facilities shall conduct the quality management and process control of the design, manufacturing, installation and nondestructive testing of civil nuclear safety equipment, and will handle the supervision of manufacturing, inspection and acceptance of such equipment. Furthermore, they are to undertake the inspection, testing and repair of civil nuclear safety equipment in service and take full responsibility for the application and operational safety of the equipment.
Article 6 Nuclear Safety Regulatory Authority of the State Council shall supervise and manage the design, manufacturing, installation and nondestructive testing of civil nuclear safety equipment.
Chapter II Permits
Article 7 Any entity applying for a permit to design, manufacture, install civil nuclear safety equipment or conduct nondestructive testing on it shall submit an application to Nuclear Safety Regulatory Authority of the State Council according to the type of engaged activities, category of equipment and level of nuclear safety considered.
Any entity applying for a permit to conduct nondestructive testing of civil nuclear safety equipment shall submit an application to Nuclear Safety Regulatory Authority of the State Council according to the methods of nondestructive testing that are being considered. Methods of nondestructive testing include radiographic testing (RT), ultrasonic testing (UT), magnetic particle testing (MT), eddy current testing (ET), penetrant testing (PT), leak testing (LT), visual testing (VT), etc.
Article 8 An entity applying for a permit to design, manufacture, install civil nuclear safety equipment or conduct nondestructive testing on it shall meet the following conditions:
(1) Having a legal person status;
(2) Having work performance related or similar to the proposed activity for at least five years;
(3) Having specialized technical personnel who are qualified after examination and suitable for the proposed activity, of whom those engaging in the weld and nondestructive testing of civil nuclear safety equipment shall have obtained the relevant certificates of qualification;
(4) Having the workplaces, facilities and equipment suitable for the proposed activity;
(5) Having a complete management system, a sound quality assurance system, and a quality assurance program consistent with the nuclear safety regulatory rules.
Specific technical requirements for an entity applying for a permit to design, manufacture, install civil nuclear safety equipment or conduct nondestructive testing on it of different types and levels of nuclear safety shall be stipulated by Nuclear Safety Regulatory Authority of the State Council.
Any entity applying for a permit to manufacture or install civil nuclear safety equipment shall produce a typical prototype based on the type of equipment, level of nuclear safety, scope of activity, manufacturing and installation technique, material designation and structural type, etc. as shown in its application.
The specific requirements for producing such a prototype shall be stipulated by Nuclear Safety Regulatory Authority of the State Council.
Any entity applying for permits to design and manufacture civil nuclear safety equipment at the same time shall have to complete the corresponding verification tests during the process of producing the prototype.
Article 9 Any entity applying for a permit to design, manufacture, install or conduct nondestructive testing of civil nuclear safety equipment shall submit the application and the certificates in compliance with the conditions specified in Article 8.
Any entity applying for a permit to manufacture or install civil nuclear safety equipment shall also submit the production scheme, quality plan and other documents in relation to the prototype.
Any entity applying for permits to design and manufacture civil nuclear safety equipment at the same time shall have to submit an evaluation test program and all necessary related documents.
Article 10 Nuclear Safety Regulatory Authority of the State Council shall undertake the formal examination of applications submitted and accept all applications that meet requirements.
Article 11 In the process of examining a permit application, Nuclear Safety Regulatory Authority of the State Council shall call on experts to undertake technical evaluations, and seek comments from the competent department of the State Council in the nuclear industry as well as those from other relevant departments. The methods of technical evaluation include documents review, post-review discussion and on-site inspection, etc.
